1.2. You are entirely responsible for your health choices and actions. MyMotionFit and its affiliates disclaim any liability for outcomes resulting from your use of the Product.

1.3. You agree to:

• Consult a licensed healthcare professional before making any changes to your fitness or dietary regimen.
• Discontinue any activity if you experience discomfort, pain, dizziness, or shortness of breath.
• Recognize that exercising entails inherent risks, which you voluntarily assume.

1.4. If you have a history of cardiovascular issues, high blood pressure, joint problems, or any other health concerns, we strongly recommend obtaining medical clearance prior to using the Product.

1.5. We are not liable for injuries or health complications arising from your participation in any activities within the programs offered.

2.1. We grant you a personal, limited, non-transferable, non-exclusive license to access the Product for your personal use, subject to payment and compliance with these Terms.

2.2. This license is effective until either you or we terminate the agreement.

2.3. All content within the Product is protected by copyright, trademark, and other intellectual property laws.

2.4. Using the Product does not grant you ownership of any content.

2.5. You may not alter, distribute, reproduce, resell, or create derivative works from any part of the Product or its content.

3.1. To utilize the Product, you will need to create an account and provide accurate personal information.

3.2. It is your responsibility to keep your account credentials confidential. We are not liable for unauthorized access due to your failure to maintain security.

3.3. If your account is used by someone else, we will not be responsible for any subsequent damages.

3.4. You must be at least 18 years of age to create an account. Accounts belonging to minors will be removed.

3.5. To delete your account, please contact us at [email protected]. Active subscriptions will be canceled, and refunds are only granted under specific conditions as outlined in section 7.

4.1. The Product provides access to structured fitness programs (such as stretching, twerk, and slimming) and personalized meal plans.

4.2. Descriptions of results or benefits are general and depend on individual body types, habits, and lifestyles.

Payments are securely processed via third-party payment providers. Their procedures and terms govern all transactions.

6.1. We offer a four-day trial subscription for a nominal fee of 0.99 USD. If you do not cancel your subscription before the trial period concludes (ninety-six hours), you will be automatically charged 9.99 USD for a weekly subscription. Please note that if a trial is offered, this will be clearly stated on the pricing screen prior to checkout. If not mentioned, you will purchase a subscription without a trial. We may also offer discounts and promotions from time to time.

• Standard Trial: 0.99 USD for 4 days
• Standard Weekly Subscription: 9.99 USD per week
• Standard 6-Month Subscription: 99.99 USD for the full 6-month period

Trial Period, Time Calculation, and Billing:

The trial access period is calculated strictly in hours, not calendar days. The trial begins at the precise moment your payment is confirmed, based on the system timestamp recorded in UTC.

For clarity, the trial is referred to as "four days" for convenience only; legally, it is defined as lasting from 94 to 98 hours.

Billing may occur at any time after 94 hours from the start of the trial, at the sole discretion of our billing system.

The Company cannot guarantee billing will occur at the precise 96-hour mark. The hour-based calculation prevails over any calendar-day interpretation. It is your responsibility to track the trial duration and cancel the subscription before the applicable billing period if you do not wish to continue.

6.2. A single payment option is available, granting access for 6 months from the payment date at a rate of 99.99 USD. This includes full account access and all fitness courses.

7.1. Refunds are provided only if access has not been granted following valid payment.

7.2. Please contact us at [email protected] for any issues. We aim to resolve concerns within 14 business days.

7.3. Refunds will be processed using your original payment method in accordance with the payment provider's policies.

7.4. Refunds are not issued if you:

• Did not utilize the Product;
• Did not complete programs;
• Were unable to access features for reasons out of our control.

7.5. No refunds apply if you choose to cancel your subscription.

7.6. If we cancel your access due to a violation of these Terms, no refund will be issued.

7.7. If we terminate services of our own accord (not due to your fault), you will receive a partial refund for any unused portion.

By subscribing, you authorize automatic renewal unless canceled in your account settings.

You are prohibited from:

• Using the Product for commercial purposes or unlawful activities.
• Sharing others' private information.
• Sending unsolicited promotions or spam.
• Harassing, abusing, or threatening other users.
• Modifying or reverse-engineering the Product.
• Attempting to access another user's data or hacking the system.

Any feedback, suggestions, or ideas you provide are considered non-confidential. You grant us the right to use them freely without any obligation to you.

We may include links to external websites that we do not control. We are not responsible for their content, policies, or any consequences stemming from your use of those websites.

The Product may feature advertising content. We are not liable for the accuracy or effectiveness of any advertisements presented within the Product.

The Product is offered "as is" with no guarantees of performance, reliability, or results. Your use is at your own risk.

You agree to indemnify and hold MyMotionFit harmless from any claims, damages, or losses arising from your use of the Product or violation of these Terms.

16.1. We are not liable for indirect damages, lost profits, or data loss.

16.2. If liability is imposed, it is limited to a maximum of $100.

16.3. We are not responsible for interruptions resulting from events beyond our control (e.g., war, natural disasters, power outages).

17.1. You may cancel your account at any time.

17.2. We may suspend or terminate access if you breach these Terms.

17.3. We may also terminate without cause by giving you notice.

17.4. Upon termination, you are required to cease all use of the Product.

17.5. Any outstanding payments remain due.

18.1. These Terms are governed by the laws applicable to MyMotionFit.

18.2. We will seek to resolve disputes amicably via email. If unresolved, disputes will be settled in the appropriate court for MyMotionFit.

19.1. If any portion of these Terms is deemed invalid, the remainder will still apply.

19.2. These Terms constitute the complete agreement between you and us.

19.3. Clause titles are for convenience and are not legally binding.

19.4. You may not assign your rights. We may transfer our rights.

19.5. No agency or partnership is created through this agreement.

19.6. Our failure to enforce any right does not constitute a waiver of that right.
